Terms of Service — Daisy for iPhone and iPad
Last updated October 20, 2026
Daisy for iPhone and iPad (the “App”) is published by Apexis Solutions Inc., doing business as Small Bricktory (“Small Bricktory,” “the Studio,” “we,” “us”). These Terms of Service (the “Terms”) are the agreement between you and the Studio for your use of the App. They work alongside our Privacy Policy for iPhone and iPad.
By downloading, installing, or using the App, you agree to these Terms. The App may also ask you to accept them the first time you run it.
Scope. These Terms govern the App only. Daisy for desktop has its own Terms of Service. A Daisy license covers up to three devices you own or control, across the App and the desktop app together.
1. License grant
Subject to these Terms and to your valid license, the Studio grants you a personal, non-exclusive, non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
The App is proprietary software, licensed to you and not sold. The Studio retains all rights, title, and interest in the App that are not expressly granted to you here. The Daisy name and logo are trademarks of the Studio. Third-party open-source components keep their own licenses and are listed in the App under Settings → About.
2. Acceptable use
Except to the extent any of the following is prohibited by law that applies to you, you agree not to:
- resell, sublicense, rent, lease, share, distribute, or otherwise make the App or your license available to anyone else;
- reverse-engineer, decompile, or disassemble the App, or attempt to derive its source code;
- circumvent, disable, or tamper with license checks, device or seat activation, or any security or technical limitation in the App;
- remove or alter any proprietary notices, or use the App to build a competing product; or
- use the App for any unlawful purpose.
3. Your content stays yours
Your audio recordings, transcripts, summaries, notes, tags, and voiceprints are yours. We do not receive them. You are responsible for backing up your own data. Deleting the App removes its data from this device; copies already synced to a computer you paired stay there.
4. Your responsibilities
Recording, notice & consent. You are solely responsible for knowing and complying with all laws on recording, notice, and consent in every jurisdiction where you record, and for how you use your recordings. This includes notifying or obtaining consent from the people being recorded where the law requires it. The same applies to enrolling speaker voiceprints: where a law such as a biometric-privacy statute requires notice or consent to collect or process biometric identifiers, obtaining it is your responsibility. We are not liable for your use of the App, including any failure to give required notice or obtain required consent.
Your device. Keeping your device secure is your responsibility. We cannot recover data from a lost, wiped, or damaged device.
Bring-your-own AI keys. If you connect a third-party AI provider with your own API key, that provider’s terms apply and it bills you directly. We are not a party to that relationship.
Health information (PHI). Recording, transcription, speaker identification, and summaries can run entirely on your device. On-device summaries require iPhone 15 Pro or later; on earlier devices, summaries need a third-party AI provider and transcript text leaves the device. Small Bricktory does not receive your recordings, transcripts, or PHI. We are not a “business associate” under HIPAA and do not enter into Business Associate Agreements (BAAs). If HIPAA applies to you, you remain responsible for your own compliance. With a third-party AI provider, transcript text goes directly from your device to that provider under your own account and key, and any required BAA with that provider is your responsibility.
Automated analysis and AI-use laws. You are responsible for what you ask the App to produce and how you use the result. Some uses are restricted by law — for example, the EU AI Act prohibits using AI to infer people’s emotions in workplace or educational settings.
5. Free trial, licenses, purchases & billing
Free trial. The App comes with a 30-day free trial that starts the first time you run it. When the trial ends, recording requires a license; everything you already recorded stays available on your device. Each device gets one trial.
Purchases made through the App Store. Apple is the merchant of record. Payment, taxes, renewal, and billing are handled by Apple under the Apple Media Services Terms and Conditions. Prices, plan terms, and any auto-renewal are as presented by Apple at purchase. Manage or turn off auto-renewal in your Apple Account settings. An App Store purchase creates a Daisy license: the App shows its key in Settings, and that key activates Daisy on your other devices within the device limit. Buying the lifetime purchase leaves an App Store subscription running; cancel it in your Apple Account settings. You can request a refund from Apple, and Apple decides.
Licenses bought from Small Bricktory. If you hold a license bought directly from us, you may sign in to it in the App with the email address it was bought with to activate this device. Payment, taxes, renewal, and any applicable trial are as presented at our checkout. Release a seat in Settings to free it for another device.
Prices exclude taxes unless stated at checkout. Price changes apply to future terms only. For licenses bought from us, a new price takes effect at your first renewal at least 30 days after we email you about it, and you may cancel without charge.
6. Cancellation & refunds
Purchases made through the App Store are cancelled in your Apple Account settings and refunded by Apple under Apple’s refund policy.
Licenses bought from Small Bricktory may be cancelled at any time, with no cancellation charge. The license then continues through the end of the term you have already paid for. Payments are non-refundable, except as stated here or required by law. If you live in British Columbia and cancel after a renewal, we refund the unused part of the renewed term within 15 days. The same applies wherever local law gives this right. If you live in the EU or UK, you may withdraw within 14 days of purchase, or of any renewal where the law provides it, for a full refund. Tell us by any clear statement: use the withdrawal page or email support@daisylocal.app. We confirm your withdrawal by email and refund you within 14 days, to your original payment method, at no cost. The Perpetual license is a one-time purchase that does not renew. Nothing in these Terms limits your non-waivable consumer rights.
7. Suspension & termination
We may suspend or end your license if you breach these Terms — for example, by misusing the App, circumventing license or device enforcement, or using the App unlawfully. We may also end your license if a required payment is not made. Where it is reasonable to do so, we will give you notice and a chance to fix the problem first.
If we end your license for cause, you are not entitled to a refund of fees already paid, subject to the mandatory consumer-protection rights described above. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification, and governing law — continue to apply after your license ends.
8. Updates & changes to the App
The App Store delivers updates. We may change or remove features and stop supporting older versions of iOS and iPadOS. We are not obligated to provide updates, new features, or support.
9. Disclaimers
To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted or error-free.
Transcripts, speaker labels, and AI-generated summaries may contain errors, omissions, or inaccuracies, and are not a substitute for your own review and judgment. Activation and license check-in services may be unavailable. You use the App at your own risk. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you; where such warranties or rights apply, the disclaimers above apply only to the extent permitted.
10. Limitation of liability
To the maximum extent permitted by law, the Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any and all claims relating to the App or these Terms will not exceed the greater of (a) the amount you paid for the App and its license in the twelve (12) months before the event giving rise to the claim, or (b) CAD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages or liability. Where that is the case, the limitations above apply only to the fullest extent those jurisdictions permit.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Studio, and its owners, officers, and contributors, from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your content and recordings, your compliance or non-compliance with recording, notice, and consent laws or biometric-privacy laws, your use of third-party AI providers, or your breach of these Terms or of applicable law.
12. Governing law
These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree to the jurisdiction of the courts located in British Columbia, Canada for any dispute that is not otherwise resolved. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will provide notice — for example, by updating the “Last updated” date above, in the App, or by other reasonable means. Your continued use of the App after the changes take effect means you accept the updated Terms.
14. Terms required by Apple
The App is distributed through the App Store. Apple Inc. requires the following, and it applies to your use of the App.
- This agreement is with us, not Apple. These Terms are concluded between you and Small Bricktory only, and not with Apple. Small Bricktory alone, not Apple, is responsible for the App and its content.
- Scope of licence. The licence granted to you for the App is as set out in section 1: non-transferable, for use on Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. Small Bricktory is solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
- Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the sole responsibility of Small Bricktory.
- Product claims. Small Bricktory, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims. If a third party claims that the App or your possession and use of it infringes that party’s intellectual property rights, Small Bricktory, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

- Third-party terms. Follow any third-party terms that apply, such as your wireless data plan.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
15. Beta testing through TestFlight
This section applies when you use a beta build of the App that you received through Apple’s TestFlight service. In addition to these Terms, your use of TestFlight is governed by Apple’s TestFlight Terms of Service. Where this section conflicts with the rest of these Terms, this section controls for beta builds.
- Beta builds are pre-release software. They may be incomplete, contain errors, or lose or corrupt data, and they are provided “as is” under Section 9 without any commitment to availability or performance.
- A beta build may expire, and we may change, pause, or end the beta program, or remove you from it, at any time.
- Feedback you send us, through TestFlight or otherwise, is voluntary. You grant us the right to use it to improve Daisy, without obligation or compensation to you.
- Apple’s TestFlight terms ask you to keep beta builds confidential and not to share them with anyone outside the program.
